The Supreme Court has issued its opinion regarding criminal immunity for former Presidents. Their opinion benefits Trump as would be expected from a majority conservative court.
They indicated that former Presidents are immune from criminality for anything done as a part of their official duties. However, they did NOT indicate what an unofficial duty might be. That, evidently, is up to the lower courts to hash out.
IMHO anything having to do with running for office, or trying to stay in office, is not a part of their official duties. It’s part of their activities as a private citizen.
Trump is still facing multiple court cases – many of which relate to trying to get back into office – or stay in office as it relates to the 2020 election. It would be nice if those cases could be resolved before the November 5th election, but probably none will be. That is since prosecutors now have to re-evaluate their cases to make sure none of their evidence is something that derives from the former President’s official activities while in office.
An example of that would be his speech galvanizing and entreating rabid supporters to go over to the Capitol Building and fight like hell. Is that part of an official activity or is it a part of trying to stay in office? IMHO it has to be considered the latter. Therefore it would be admissible as evidence.
We need to vote to re-elect Biden and allow the Trump court cases to continue. We don’t want TFG back in office anyway.
